1. Introduction
Teraplay respects the intellectual property rights of others and
expects its users to do the same. In accordance with the Digital
Millennium Copyright Act of 1998 ("DMCA"), we have established
the following policy to respond to notices of copyright
infringement.
2. How Teraplay Works
It is important to understand that Teraplay does not host,
store, or distribute any content itself. Our service acts as a
player interface to play content that is hosted on Terabox's
servers. We do not have control over what content users access
through our player.
3. DMCA Notification Requirements
If you believe that content accessible via our service infringes
your copyright, you may request removal of those materials by
submitting a DMCA notice containing the following information:
-
A physical or electronic signature of a person authorized to
act on behalf of the owner of the copyright that has been
allegedly infringed;
-
Identification of the copyrighted works claimed to have been
infringed;
-
Identification of the material that is claimed to be
infringing and information reasonably sufficient to permit
Teraplay to locate the material;
-
Information reasonably sufficient to permit Teraplay to
contact you, such as an address, telephone number, and, if
available, an electronic mail address;
-
A statement that you have a good faith belief that use of the
material in the manner complained of is not authorized by the
copyright owner, its agent, or the law; and
-
A statement that the information in the notification is
accurate, and under penalty of perjury, that you are
authorized to act on behalf of the owner of the copyright that
is allegedly infringed.
4. How to Submit a DMCA Notice
DMCA notices should be sent to our designated agent via:
Upon receipt of a proper notification of claimed infringement,
we will follow the procedures outlined in the DMCA, which may
include removing or disabling access to the allegedly infringing
content and/or terminating the accounts of repeat infringers.
5. Counter-Notification
If you believe that your content was removed due to a mistake or
misidentification, you may submit a counter-notification that
includes:
- Your physical or electronic signature;
-
Identification of the material that has been removed or to
which access has been disabled and the location at which the
material appeared before it was removed or access to it was
disabled;
-
A statement under penalty of perjury that you have a good
faith belief that the material was removed or disabled as a
result of mistake or misidentification; and
-
Your name, address, and telephone number, and a statement that
you consent to the jurisdiction of the federal court for the
judicial district in which your address is located, or if your
address is outside of the United States, for any judicial
district in which the service provider may be found, and that
you will accept service of process from the person who
provided the original notification of alleged infringement.
6. Repeat Infringers
In appropriate circumstances, Teraplay will disable and/or
terminate the accounts of users who are repeat infringers. We
consider a "repeat infringer" to be any user who has uploaded or
submitted content for which we receive more than two DMCA
takedown notices. We reserve the right to terminate accounts for
a single act of infringement, at our discretion.
7. Modifications to Policy
Teraplay reserves the right to modify this DMCA Policy at any
time. Changes will be effective immediately upon posting to the
website.
